What buyers should establish first
Confirm who owns the property, how it is recorded in the revenue record, whether the seller can transfer it, whether access is documented and whether the intended use is permitted. An apartment, a built residence and agricultural land can present different legal and approval questions.
How Section 118 fits in
Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act restricts certain transfers of land to people who are not agriculturists, subject to the Act, rules, exemptions and permission process. Eligibility should be assessed against the current law and the facts of the exact property.
Practical due diligence
Use an independent Himachal qualified lawyer to review the title chain, revenue entries, encumbrances, mutation history, sanctioned plans, completion or occupancy evidence where relevant, RERA information where applicable, and any permission relied upon by the seller or buyer.
