What Section 118 does
The provision restricts certain transfers, including by sale, gift, lease, mortgage with possession or otherwise, in favour of a person who is not an agriculturist, subject to the statutory text and its provisos. It should not be reduced to a slogan that outsiders can or cannot buy.
Why the property type matters
Revenue classification, existing lawful construction, the nature of the interest being transferred and the intended use can change the analysis. Marketing labels such as cottage, villa or plot do not replace the official land and approval records.
A safer buyer process
Obtain a property specific written opinion, confirm whether permission is required, inspect the permission and its conditions if one is relied upon, and ensure the sale documents match the approved purpose and property particulars.
