Short answer

Uttarakhand property rules differ by land type, district, buyer status and intended use. The 2025 state amendment restricts purchases of agricultural and horticultural land by people from outside the state in 11 hill districts. Built property and non agricultural transactions still require title, land use, approval and registration checks.

Start with land classification

Identify the exact khasra and khatauni entries, present land use, district and development authority. Do not infer legal use from a brochure, a building’s appearance or nearby construction.

Agricultural and horticultural land

The Uttarakhand government states that its 2025 amendment prohibits people from other states from purchasing agricultural and horticultural land in 11 hill districts. Buyers should verify the current statutory text, any exceptions and the property record before proceeding.

Registration is not the whole diligence process

Registration records a transaction and gives public notice. It does not replace investigation of title, encumbrances, land use, access, building approvals, RERA status where applicable or purchaser eligibility.

Buyer questions

Can an out of state buyer purchase a home in Uttarakhand?

The answer depends on the property and transaction. Agricultural and horticultural land restrictions require particular care, while any built property purchase still needs full title and approval review.

What is Section 154 permission?

The Uttarakhand Board of Revenue provides an official land purchase permission service under Section 154. Whether it applies must be determined for the specific buyer and land.

Does registration prove clean title?

No. Registration is important, but independent title and encumbrance checks remain necessary.
